Terms

How we work, in plain English

These terms cover every website, plan and job we do. They’re written to be read, not scrolled past. If anything’s unclear, ask before you book in and we’ll explain it.

Last updated 4 October 2026Applies to work booked from that date

The short version

Every request is one of three things

Once your site is live, anything you ask us for lands in one of these. Each one has a clear answer, so there are no grey areas and no surprise bills.

Is something broken?

Something we built isn’t working

A form that won’t send, a link that goes nowhere, a page that looks wrong on a phone.

Fixed free What counts as a bug

Is it an update?

A change to what’s already there

New prices, opening hours, photos or wording, inside your current design.

Covered by Care What counts as a small change

Is it new?

Something your site doesn’t do yet

A new page, online booking, a gallery, a fresh look.

Quotes and booking in

  • Quotes are free, and asking for one doesn’t commit you to anything.
  • Every quote lists exactly what’s included: the pages, the features and the price. If it isn’t in the quote, it isn’t in the price.
  • A quote is valid for 30 days.
  • You book in by paying the deposit. Paying it means you accept these terms as they read on the day you paid.

Payments

  • Website builds: 50% deposit to book in. The other 50% is due when you approve the finished site, before it goes live on your domain.
  • Invoices are due within 7 days.
  • Care and Grow are billed monthly in advance, starting on your launch day. They’re month to month, with no lock-in contract.
  • Prices are in Australian dollars. 79th isn’t registered for GST, so no GST is charged.
  • If a payment is late, we’ll send a friendly reminder. If a monthly plan is more than 14 days overdue, we pause the plan’s work until it’s sorted. After 30 days, we treat the plan as cancelled and the handover applies.
  • We will never take your site offline to chase a payment.

The build

What’s included

Exactly what’s in your quote. Our Starter and Professional sites are described on the pricing page.

Timing

  • Starter sites take about a week and Professional sites about two. The clock starts once we have everything on your checklist: logo, photos, wording and business details.
  • You get a private preview link early, so you can watch the site come together.
  • If we’re running late, we’ll tell you why before the date passes.

What we need from you

  • The content on your checklist, which lives in your dashboard. On Professional, we write the words for you.
  • Anything you send us has to be yours to use. Photos, logos or text made by someone else need their permission.
  • The facts on your site (prices, licence numbers, claims, reviews) need to be accurate. We’ll ask you to check them before launch.

Feedback

  • Two rounds of changes are included. A round is one list of everything you’d like changed, sent together.
  • Extra rounds, or anything outside your quote, are priced first. You get a fixed price, and nothing extra is charged without your OK in writing (an email is fine).

If things stall

  • If we’re waiting on something from you for 30 days, we’ll check in.
  • After 60 days with no word, we put the project on hold, and your deposit covers the work done to that point. Picking it back up is easy. If it’s been more than six months, we’ll check the quote still fits.

Launch

  • Before anything goes live, we run every site through our 72-point checklist: speed, security, phones, accessibility, search, and every link and form.
  • When you’ve approved the site and the balance is paid, we put it live on your domain.
  • Launch day is when your 12-month bug warranty starts, and when Care starts if you’ve chosen it.
  • We send you a launch email with your warranty end date, what’s covered, and how to ask for changes.

Bug fixes: our 12-month warranty

A bug is something we built that doesn’t work the way it did when you approved it, or the way we agreed it would.

These are bugs, fixed free

  • Your enquiry form doesn’t send, or sends to the wrong place
  • A button or link goes nowhere, or to the wrong page
  • A page looks broken on a current phone, tablet or computer
  • Images that don’t load, or a menu that won’t open
  • A spelling or grammar mistake in words we wrote
  • The site slowing down because of our code

These aren’t bugs

  • Updating prices, hours, photos or wording. That’s a small change.
  • Adding a page, a section or a feature. That’s quoted.
  • Changes of taste after you’ve approved the site (“can the button be blue now?”)
  • Problems caused by someone else editing the site, or by an outside service changing how it works
  • Very old browsers. We support the current and previous versions of Safari, Chrome, Edge, Firefox and Samsung Internet.
  • Content you supplied, your email, your devices or your internet connection

Even when something isn’t a bug, we’ll still help. We’ll tell you what’s needed and what it costs, if anything.

How long it lasts

12 months from your launch day. If you’re on Care or Grow, bug fixes stay free for as long as you’re on the plan.

How to claim

  • Email hello@79th.au, or use “Ask for a change” in your dashboard. Tell us the page and what happened. A screenshot helps.
  • Claiming costs you nothing, and we pay for the fix.

What we’ll do

  • Reply within one business day.
  • Urgent problems (the site is down, the form isn’t sending, or there’s a security issue) are worked on the same business day.
  • Everything else is usually fixed within two business days, and always within five. If a fix will take longer, we’ll tell you why and when it’ll be done.

This warranty is given by 79th (Calvin J T Greely, ABN 57 953 059 478), 4 Beryl Place, Lennox Head NSW 2478, 0403 845 815, hello@79th.au.

Your rights under the Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

The benefits of this warranty are in addition to your other rights and remedies under the law.

Care, $39 a month

What’s included

  • Hosting, looked after. Your site on Cloudflare’s network, in your account, with us keeping an eye on it.
  • Monitoring. We check your site is online every 5 minutes, so we hear about a problem before your customers do.
  • Security. Your security settings checked every day and kept up to date.
  • Every version saved. Any page can be put back the way it was.
  • Domain watch. We track your renewal date and remind you well before it’s due.
  • Bug fixes for as long as you’re on Care, even after your 12 months.
  • Your dashboard, with visits, Google search, security and change requests in one place.
  • Small changes whenever you need them.

What counts as a small change

A small change updates something already on your site, fits inside your current design, and takes us 30 minutes or less.

These are small changes

  • New prices, opening hours, phone number, email or address
  • Swapping or adding a few photos
  • Editing the wording on a page
  • Adding a service, menu item, team member or review to a list that’s already there
  • A notice for holidays or a special offer
  • Updating a PDF, like a menu or price list

These aren’t, so we quote first

  • A new page, section or layout
  • New features like booking, payments, a shop, a map or a gallery
  • A redesign or a new look
  • Writing lots of new content, or SEO work (that’s Grow)
  • Logos, branding, photography or drone work

How many, and how fast

  • Send as many as you need. Fair use is about an hour of changes a month in total, and unused time doesn’t roll over.
  • Small changes are done within two business days.
  • If a request is bigger than a small change, we’ll say so and give you a price before doing anything.

Billing

$39 a month, billed in advance from launch day. Month to month, with no lock-in and no exit fee.

Grow, $149 a month

Everything in Care, plus the ongoing work that helps more local customers find you.

  • Google Business Profile posts, so your listing stays active.
  • Local SEO upkeep: your business listings, service-area pages, and the technical health search engines look for.
  • A short monthly note on how you’re tracking: visits, searches and enquiries.

Search takes time. It usually takes a few months to see real movement, and nobody can honestly guarantee a ranking, because Google decides. We’ll always show you what we did and what changed.

Grow is month to month. You can switch between Grow and Care, or cancel, at any time.

When the 12 months are up

  • On Care or Grow: nothing changes. Bugs are still fixed free.
  • Not on a plan: your site keeps running as it is. If something breaks, we give you a fixed price before we fix it. You can join Care at any time.
  • We email you a month before your warranty ends, so it’s never a surprise.

If you cancel a plan

  • Cancel any time, by email or in your dashboard. No exit fee and no notice period.
  • Your plan runs to the end of the month you’ve paid for, then stops. No more charges.
  • Your site keeps running. It’s on your domain, in hosting accounts in your name, so nothing moves and nothing goes offline.
  • Within five business days we send your handover: a copy of every file, a list of your accounts and settings, and simple notes on making edits.
  • If part of your site runs on an account of ours (like the service that sends your form emails, or the AI auto-reply), we move it to an account in your name first, so it keeps working. If it has a running cost, we’ll tell you what it is.
  • We remove our access to your accounts, unless you’d like us to stay on for paid one-off jobs.
  • What stops: small changes, monitoring, dashboard access, and free bug fixes once your 12 months are up.
  • You can come back any time.

Hosting

  • Your site runs on Cloudflare, one of the largest networks in the world, so it loads fast wherever your customers are.
  • It lives in a Cloudflare account in your business’s name. For most sites, that account is free. We’re added as a member so we can look after it.
  • Unless your quote says otherwise, we build without WordPress, plugins or a database. There’s much less to go wrong, and much less for anyone to break into.
  • If you’d rather use a different host, tell us before we quote.

Domains and email

  • Your domain is registered in your business’s name, never ours. For a .com.au, the .au rules require that anyway.
  • Already have one? Keep it where it is. You add us as a user, or point it at your Cloudflare account, and we handle the settings.
  • Need one? We set it up with you, in your name, with auto-renew switched on. The yearly fee is paid to the registrar, not to us.
  • Your email keeps working. We don’t host email, and when we connect your domain we keep your email settings exactly as they are. We also add the records that stop scammers sending fake emails and invoices from your domain.
  • Leaving? Your domain is already yours. We’ll help you move it wherever you like, free.

Security

How your site is protected

  • Nothing to log in to. With no WordPress, plugins or database, there’s no admin login on your site for anyone to guess and no plugins to patch.
  • The padlock, always. Every page loads over a secure connection that renews itself, and browsers are told never to use an insecure one.
  • Strict browser rules. Security settings tell browsers to run only our code, and stop your site being loaded inside someone else’s page.
  • Attacks stopped at the door. Cloudflare blocks attacks and bad bots before they reach your site.
  • Safer forms. Every form has spam protection. Enquiries go straight to your inbox, and your site doesn’t store them.
  • Every change saved. If anything goes wrong, any version of your site can be restored in minutes.

How we look after access

  • Two-step login on every account we use for your site: hosting, domain, code and email.
  • Passwords live in a password manager and are never sent by email or text.
  • Secret keys are kept in encrypted storage, never in your site’s code.
  • We will never ask for your password. To give us access, you invite us from inside the account, and you can remove us any time.
  • Your dashboard login uses a one-time code sent to your email, so there’s no password to steal.

If something goes wrong

We tell you straight away: what happened, what we’ve done, and anything you need to do. Nobody can honestly promise a site will never have a problem. What we promise is a small target, daily checks and fast fixes.

Your dashboard

  • Every client gets their own private dashboard.
  • You sign in with your email address. We email you a one-time code each time, so there’s no password to remember.
  • During your build it shows your progress, your checklist and your preview link. After launch it shows visits, Google search, security checks, and a box to ask for changes.
  • Your dashboard stays with you while you’re on Care or Grow. Want someone else in your business to have access? Just ask.

Who owns what

  • Once you’ve paid in full, your site is yours: the design, the words we wrote for you, the code and the files.
  • Until then, the work stays ours, and it isn’t put live.
  • We keep the right to reuse our general tools, code and know-how on other projects. You get a permanent licence to use them as part of your site.
  • Your content stays yours. You give us permission to use it to build and run your site.
  • We may show your site in our portfolio and on social media. Tell us if you’d rather we didn’t.
  • Sites carry a small “Website by 79th” credit in the footer. Ask and we’ll remove it.

What we can’t promise

  • Google rankings. No one can guarantee a spot on Google. We build to Google’s guidelines and report honestly on results.
  • Other companies’ services. Hosting, maps, booking systems, payments and AI services are run by other companies. We’re not responsible for their outages or changes, but we’ll help you sort them out.
  • AI auto-replies (on Professional sites) are set up to thank people and tell them what happens next. They don’t quote prices or make promises for you, and you approve the wording before launch.
  • Liability. As far as the law allows, we’re not liable for indirect losses such as lost profits, and our total liability is limited to what you paid us in the 12 months before the claim. None of this limits your rights under the Australian Consumer Law.

Ending a project early

  • You can end a build at any time. You pay for the work done up to that point, and we refund any of your deposit that’s left over.
  • We can end a project if we have to, for example if we’re asked to publish something unlawful. If we do, we refund anything you’ve paid for work we haven’t done.

Changes to these terms

  • If we update these terms, we email current clients at least 30 days before the change affects them.
  • If you don’t agree with a change, you can cancel your plan with no fee.
  • A build that’s already under way stays on the terms you agreed to.

Privacy

What we collect

  • From our quote form: your name, email, phone, town and your answers.
  • From clients: contact and billing details, and visitor statistics for your site from Cloudflare Web Analytics and Google Search Console.

Why we collect it

To reply, quote, build and look after your site, and to send things like invoices and renewal reminders. We don’t sell or rent anyone’s details, and we don’t send marketing without permission.

Who sees it

  • Only us, plus the services we use to run 79th: Cloudflare (hosting and visitor statistics), Zoho (email), Google (search data) and our payment provider. Some of these may store data outside Australia.
  • 79th.au doesn’t use tracking cookies, and our visitor statistics don’t identify you.

Your choices

  • Ask to see or correct the information we hold about you at hello@79th.au.
  • If you’re unhappy with how we’ve handled your information, tell us first. If we can’t put it right, you can contact the Office of the Australian Information Commissioner at oaic.gov.au.

Contact

Questions about any of this, a bug to report or a change to ask for: hello@79th.au or 0403 845 815.

If something isn’t right, talk to us first. Most things are sorted with one phone call. These terms are governed by the laws of New South Wales.
